FACILITY RULES RZEPNIGAJ
1. General Provisions
- These Rules and Regulations set forth the rules for staying on the premises of the „RzepniGaj” Complex.
- These Terms and Conditions are an integral part of the agreement, which is concluded at the time of check-in, as well as through implied actions (i.e., actions that are deemed to constitute an agreement), in particular by making a reservation and/or paying a deposit or the full amount for the stay. By performing the above actions, each Guest confirms that they have read the Terms and Conditions, accept them, and agree to the terms contained therein.
- The entity making the facility available is Sandhill Sp. z o.o., with its registered office in Wojaszówka (38-471), Wojaszówka 12, entered in the Register of Entrepreneurs under KRS number: 0001047720, Tax ID (NIP): 6848678016, Statistical Identification Number (REGON): 525873032, share capital: 5,000.00 PLN, represented by: Paweł Modliszewski – President of the Management Board.
- Definitions:
- The „RzepniGaj” Complex (hereinafter referred to in these Terms and Conditions as the „Complex”) – the entire infrastructure located on Plot No. 249/1 in the village of Rzepnik, including, in particular, residential buildings, hot tubs, a sauna, and technical infrastructure
- House – a residential building or buildings that are part of the „RzepniGaj” complex.
- Landlord – Sandhill Sp. z o.o., with its registered office in Wojaszówka (38-471), at 12 Wojaszówka, entered in the Register of Entrepreneurs under KRS number: 0001047720, Tax ID (NIP): 6848678016, National Business Registry Number (REGON): 525873032, share capital: 5,000.00 PLN, represented by: Paweł Modliszewski – President of the Management Board.
- Tenant/Guest – a person who rents a unit, is staying at the property, and uses the house and the „RzepniGaj” Complex.
- These rules apply to all persons on the premises of the „RzepniGaj” Complex.
- The Terms and Conditions are available for review at the Cottages or on the website rzepnigaj.pl.
- Parking on the complex grounds, reserved for guests, is free and unguarded. There are 10 parking spaces on the complex grounds. Parking is permitted only in the designated area.
- The grounds of the „RzepniGaj” Complex may not be used for commercial or advertising purposes without the consent of the property owners. Such activities will be governed by a separate agreement under the terms and conditions set forth therein.
2. Reservations and Payments
- Reservations must be made through the reservation system available on the website rzepnigaj.pl. To reserve a cottage, you must pay a deposit equal to 30% of the total rental amount shown in the reservation system or pay 100% of the reservation amount. The reservation is confirmed upon receipt of the payment through the „imoje” payment gateway, operated by ING Bank Śląski S.A. Failure by the Guest to pay the deposit is considered a cancellation of the reservation, as a result of which no contract is concluded between the Guest and the Landlord.
- The Guest is entitled to withdraw from the contract (cancel a confirmed reservation) no later than 45 days before the start of the first night of the scheduled stay. In such a case, the Complex will refund the deposit paid by the Guest; it is possible to change the reservation dates (subject to the Complex’s availability). Cancellation must be made in writing (to the Complex’s mailing address specified in § 1(3) of the Terms and Conditions) or via email to the following address: kontakt@rzepnigaj.pl.
- In the event that a Guest:
- cancels the contract less than 45 days before the start of the first day of the scheduled stay, or
- does not check in at the Complex on the scheduled arrival date,
In that case, the deposit is non-refundable, and the reservation is canceled.
- The remaining balance for the stay, as indicated in the booking confirmation, is due in advance—no later than the day of arrival, either in cash or by bank transfer made at least 3 business days prior to arrival.
- The person designated to liaise with the Guest is required to deduct the amount of the deposit paid in advance from the total amount due. To clarify any potential ambiguities, please keep and present a copy of the payment receipt.
- In the event of an early departure, you are not entitled to a refund for any unused days of your stay.
- The guest is required to present a valid ID to verify their identity upon arrival and to provide the names of any other guests.
- If a Guest wishes to extend their stay beyond the period specified in the reservation, they must notify the Landlord by 8:00 p.m. on the day before the rental period ends. Extending the stay is possible subject to availability.
- At the time of booking, the Renter agrees to have their personal information stored in the Landlord’s database. This information will be used solely for the purpose of completing the booking process.
- The controller of personal data is Sandhill Sp. z o. o., with its registered office at 38-471 Wojaszówka
- Detailed rules regarding the processing of personal data can be found on the website www.rzepnigaj.pl under the „Privacy Policy” tab.
- Pursuant to Article 38(12) of the Act of May 30, 2014, on Consumer Rights, the Guest is not entitled to withdraw from a distance contract pursuant to this paragraph (except in the case referred to in paragraph 2 above).
3. Stay and Accommodations
- A curfew is in effect on the premises from 10:00 p.m. to 6:00 a.m.
- The maximum number of guests allowed in the property is the number specified at the time of booking. It is strictly prohibited for any unregistered guests—or for the number of guests to exceed the maximum—to stay in the property. Violation of this prohibition will result in a contractual penalty of 200 PLN for each additional person, per night of stay, and may constitute grounds for immediate termination of the rental agreement without a refund for the remaining period.
- Check-in and check-out take place on the premises of the „RzepniGaj” Complex in the presence of the Landlord, a person authorized by the Landlord, or via self-check-in.
- Check-in begins at 3:00 p.m. on the day of arrival and check-out ends at 11:00 a.m. on the day of departure. Custom check-in and check-out times are possible—to be arranged with the Landlord.
- Each rental covers the entire house within the „RzepniGaj” complex for up to 10 people. The minimum rental period is 2 nights on weekends and holidays, or 1 night on weekdays.
- The guest is required to inform the Landlord of the planned arrival time at the House no later than 2 hours before arrival.
- Remaining on the premises or leaving your belongings behind without prior arrangement with the Landlord after 11:00 a.m. on the day of departure is considered an extension of your stay, and the Landlord has the right to charge a fee for an additional night according to the current price list.
- Items left by guests on the premises after the end of their stay will not be stored by the landlord.
- The agreement between the Lessor of the „RzepniGaj” Complex and the Guest covers solely the rental of the House and its associated recreational facilities. It does not include transportation, meals, or the organization of the guest’s stay.
- Bonfires and barbecues may only be held in the area designated for this purpose by the Landlord.
- Smoking is strictly prohibited in residential areas and other facilities within the „RzepniGaj” Complex. The cottages are equipped with smoke detectors. If the smoke detectors are triggered and the Fire Department is called, the Guest will be charged for the resulting costs. For violations of points 10 and 11 of this section, the Guest may be charged an additional fine of up to 2,000 PLN.
- Smoking is permitted outside the House, but cigarette butts must be disposed of in the designated containers located on the grounds of the „RzepniGaj” Complex.
- You may not walk around the House in muddy or wet shoes. Please wear a change of shoes inside the House.
- Waste separation is required at the Cottages.
- You are permitted to use kitchen accessories and linens on the terrace adjacent to the House.
- Each time a guest leaves the house, for safety reasons, they should turn off the lights, turn off the faucets, and close the windows and doors (by latching them shut).
- Guests receive a unique door code/key that grants them access to the house. The door code will be sent via text message to the phone number provided in the reservation 12 hours before the check-in date. Guests check in to the cottages without the assistance of the property’s staff.
- Leaving personal belongings in the common areas of the „RzepniGaj” Complex is done solely at your own risk.
- The property staff is not permitted to enter the rented House without the Guest’s consent, much less move the Guest’s personal belongings. The right to enter the rented House is reserved solely in the event of a threat to the Guests’ safety or in the event that the Guests fail to comply with the House Rules.
- The tenant is required to use the House in accordance with its characteristics and intended purpose.
- Fire extinguishers are located in visible areas throughout the Complex; they must be used in the event of a fire, and the Landlord must be notified immediately. Unjustified use of a fire extinguisher will result in an additional charge of 500 PLN for cleanup and a replacement fire extinguisher.
- Due to fire safety requirements, the following are prohibited in the building:
- use any electrical or gas-powered devices or appliances that are not part of the standard equipment of these rooms and that could pose a fire hazard, such as electric heaters, radiators, or gas burners;
- bringing flammable materials, explosives, fireworks, and materials with an unpleasant odor;
- lighting a campfire or using a grill outside of the designated area.
- The use of open flames is strictly prohibited in the forest.
- In the event of technical malfunctions, the Guest is asked to report them to the Landlord by phone as soon as possible, which will allow for an appropriate response and further action.
- The Guest is not permitted, without the prior written consent of the Lessor of the „RzepniGaj” Complex, to perform any repairs or make any improvements or alterations to the House or its grounds. The Tenant is required to immediately notify the Landlord of any necessary repairs or improvements.
- Any observations regarding existing damage or wear and tear must be reported immediately to the Landlord. The Landlord acknowledges the possibility of discovering so-called “hidden” damage. If the Guest does not report any such damage within 3 hours of check-in, it is understood that the Guest has no objections regarding the entire Complex, and that all appliances and furniture are present in quantities consistent with the inventory list and in good condition.
- The rental price charged by the owner does not include insurance costs. Guests use the property and facilities throughout the complex at their own risk. The owner is not liable for any injuries, damage, or destruction of property (including damage to the health or property of third parties), nor for the theft of luggage during the entire stay.
- If the guest cancels the stay before its scheduled end date, the Landlord will not refund the payment made for the remaining portion of the stay.
- The landlord reserves the right to change the cottage selected at the time of booking in the event of unforeseen circumstances, particularly technical issues.
- Guests with electric cars may charge their vehicles on the premises of RzepniGaj by connecting to the Lessor’s power supply, provided they have notified the Lessor in advance and received the Lessor’s consent. The Landlord may charge an additional fee for connecting an electric vehicle for charging.
- If the Guest fails to inform the Lessor of the need to charge the electric vehicle and charges it without the Lessor’s consent (using the charging station in RzepniGaj), the Guest will be charged a contractual penalty of 500.00 PLN.
- The landlord reserves the right to seek damages in excess of the amount of the penalty specified.
4. Guests' Responsibilities
- Upon arrival, but before checking in, guests are required to inspect the House—that is, to check the condition of the furnishings, including furniture, windows, the shower stall, and other fixtures in the House.
- The guest bears full financial responsibility for any damage or destruction to furnishings or technical equipment caused by the guest, whether intentional or unintentional.
- Parents or guardians are responsible for the safety of children on the premises.
- Any damage will be billed within 7 days after check-out, based on an estimate prepared by the Landlord using market prices. The Landlord has the right to issue an invoice to the Guests to cover the full cost of repairing or replacing the damaged property.
- The guest may not transfer, make available, or sublet the House to third parties. The House may not be occupied or used by more people or for more days than specified at the time of booking and payment of the deposit.
- Guests are financially liable for any damage caused by their fault at the House during their stay and agree that any repairs to damage, replacement of missing items, or correction of defects, be carried out at their expense or to pay compensation fully covering the value of the losses incurred, no later than on the day of departure, in cash to the Landlord or the person responsible for the keys. The Lessor of the damaged property shall decide on the method of remedying the damage.
- Legal guardians will be financially liable for any damage to furnishings and technical equipment caused by the children.
- The guest is required to maintain and return the Cottage in its original condition, which includes, in particular, washing all dishes and kitchen utensils, emptying the refrigerator of food and other items, and leaving the area surrounding the Cottage in the same condition as when they arrived. Failure to comply with the above obligation may result in the Landlord charging an additional fee of 150.00 PLN.
5. Landlord's Liability
- The landlord is not liable for interruptions in the provision of services by third-party providers (e.g., water, electricity, gas).
- The landlord is not liable for malfunctions or unforeseeable events beyond their control.
- The owner is not liable for damage to or theft of vehicles belonging to guests.
- In the event of a violation of these Rules and Regulations or a gross disturbance of the peace by Guests, the Landlord may require them to leave the House immediately.
- The landlord is not financially liable for guests’ personal belongings left in the cottage or on the property, nor is the landlord legally or financially liable for damage to or theft of vehicles left in the parking lot (unattended parking lot). The responsibility for protecting one’s belongings against theft and damage rests with the owner.
- The landlord is not liable for the consequences of accidents, injuries, or other damages caused by guests’ irresponsible behavior or conduct that violates the Rules and Regulations.
6. Rules for Using the Hot Tub
- The hot tub is an integral part of the RzepniGaj facility (hereinafter referred to as the „Facility”)—the General Rules and Regulations of the Facility and these Rules and Regulations apply to its use.
- The hot tub is for the exclusive use of guests staying at RzepniGaj.
- Before using the hot tub, users are required to read these rules and regulations and comply with them.
- Before getting into the tub, wash your entire body in the shower with soap and warm water.
- Only healthy individuals or those whose medical conditions do not constitute contraindications may use the tub.
- Users are personally responsible for any health effects resulting from the use of the tub and do so at their own risk.
- Guests' use of the hot tub is not supervised by lifeguards or by the facility.
- Children under 13 may use the hot tub only under the supervision of adults and at their responsibility.
- Only people wearing swim trunks and/or swimsuits may use the pool.
- Anyone who destroys or damages the tub is liable for compensation for the damage caused. Anyone who damages the tub will be charged 1,500 PLN.
- Anyone who intentionally or unintentionally contaminates the tub will be charged for the cost of replacing the water (minimum 150 zł). In the case of children, the child’s guardian is responsible.
- Guests with any of the following contraindications may not use the hot tub:
- cardiovascular disorders,
- respiratory system disorders,
- neurological and gastrointestinal disorders,
- pregnancy (only after consulting a doctor),
- infectious diseases,
- externally visible dermatological conditions, dressings,
- high blood pressure,
- diabetes,
- allergy, sensitivity to chlorine,
- inflammation of the urinary tract,
- fungal infection,
- epilepsy,
- varicose veins,
- chronic diseases,
- genital diseases.
- The following is prohibited:
- use the hot tub while under the influence of alcohol or other intoxicating substances,
- have more than 6 people use the tub,
- placing any objects or chemicals in the bathtub, such as shampoo, soap, oils, bath salts, etc.,
- use the tub while eating,
- submerging the head and face,
- indecent behavior or behavior that is socially considered obscene or offensive,
- stepping into the tub while wearing shoes,
- jumping into the hot tub,
- emptying water from the tub,
- entering the hot tub in violation of the prohibition or when the hot tub is closed to guests,
- placing animals in the tub,
- placing glass, glassware, sharp objects, and any other items in the tub,
- creating a situation that endangers one's own safety and the safety of others using the bathtub, or that could result in an accident.
- Instructions for using the tub:
- Enter and exit the tub only with extreme caution,
- The person leaving the tub has the right of way,
- No more than 6 people may be in the tub at the same time,
- It is recommended to stay in the tub for no more than 30 minutes,
- Bathing in a tub is done only while sitting,
WARNING! Prolonged use of the hot tub, combined with time spent in the sauna, can cause the body to overheat. Symptoms include: convulsions, a sudden drop in blood pressure, dizziness, and fainting.
- After each time you get out of the tub, it is recommended that you run the filter pump for at least 2 hours.
- Instructions for using the tub heater:
- The stove should be fueled only with dry wood,
- Do not overheat the stove,
- Subsequent batches of wood should be added after the previous ones have burned out,
- The oven door should always be closed,
- Be especially careful when the stove is in use. The stove is hot.
- The owner is not liable for burns.
8. Rules Regarding Pets
- Pets are welcome at the „RzepniGaj” Complex (subject to prior agreement with the Landlord).
- Pets need to have their own beds.
- Dogs are allowed to stay only if they have a valid vaccination certificate. Dog owners are required to clean up after their pets.
- The presence of animals must not disturb others' relaxation.
- Pets are not allowed to sleep on the couch or in beds.
- Animals must not pose a threat to or disturb people living nearby.
- Dogs on the resort grounds must be under their owners' full control.
- The animal cannot be left alone in the house.
- Dogs must be walked on a leash under the supervision of their owner or an authorized person.
- The presence of breeds considered dangerous and crossbreeds of these breeds (i.e., Pit Bull, Rottweiler, Caucasian Shepherd, Tosa Inu, Argentine Dog, Presa Canario, American Bulldog, Anatolian Shepherd, Moscow Watchdog, Fila Brasileiro, and Akbash) is strictly prohibited. The dog owner is responsible for covering the costs of any damage caused by their dog. The owner reserves the right to refuse to allow the animal to stay on the premises.
9. Complaints
- Guests have the right to file a complaint with the Landlord in person, by phone, or in writing.
- Complaints may affect the length of your stay and the amount of the fee.
- The landlord reserves the right to respond to a complaint within 14 days of the date it was filed.
- Polish law shall govern any disputes between the Landlord and the Guest. Any disputes shall be resolved amicably; if no agreement can be reached, the matter shall be decided by the court with jurisdiction over the Landlord’s place of business.
